Terms of Service

1. The Service

KaapLiving (Pty) Ltd ("KaapLiving", "we") provides a software platform for Cape Town short-term rental hosts to automate guest communications, coordinate cleaners, track pricing, and manage deposits. These Terms govern your access to and use of the service.

KaapLiving is a software tool only. It is not a letting agent, estate agent, or property manager and is not registered with the Property Practitioners Regulatory Authority (PPRA).

2. Eligibility

You must be 18 or older and have the legal authority to enter contracts under South African law. By creating an account you warrant that the information you provide is accurate and that you are authorised to list and manage the properties you register on the platform.

3. Subscriptions & Payment

Subscriptions are billed monthly in South African Rand, inclusive of VAT. Payment is processed by Paystack, a licensed payment service provider. KaapLiving does not store your card details.

Your subscription renews automatically each month. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused days except where the 7-day money-back guarantee applies (see our Refund Policy).

We reserve the right to adjust prices with 30 days' advance notice to active subscribers.

4. Your Responsibilities

• You are responsible for ensuring your short-term letting activity complies with all applicable City of Cape Town by-laws, SARS obligations, and sectional title or lease restrictions.
• You must not use the platform to send misleading, harassing, or unlawful communications.
• You are responsible for the accuracy of property details, access codes, and cleaner contacts you enter into the platform.
• You must keep your login credentials confidential and notify us immediately of any unauthorised access.

5. AI Disclaimer

KaapLiving uses AI language models to generate guest replies and operational suggestions. These replies are generated automatically and may not always be accurate, appropriate, or complete. You retain full responsibility for all communications sent in your name.

You can take over any conversation at any time. KaapLiving accepts no liability for any loss arising from AI-generated content.

By-law exposure figures shown in the platform are indicative estimates only and do not constitute legal advice or confirm compliance with City of Cape Town short-term letting regulations or rates classification.

6. Intellectual Property

All platform software, design, and content is owned by KaapLiving or its licensors. You retain ownership of the property data and conversation content you upload. You grant KaapLiving a limited licence to process that data solely to deliver the service.

7. Limitation of Liability

To the maximum extent permitted by South African law, KaapLiving's total liability for any claim arising from these Terms or the service shall not exceed the fees you paid in the three months preceding the claim.

KaapLiving is not liable for indirect, consequential, or special damages, loss of revenue, or loss of data, even if advised of the possibility of such losses.

8. Uptime & Service Levels

We target 99.5% monthly uptime for the platform, excluding scheduled maintenance (announced 48 hours in advance) and third-party service outages (WhatsApp, Paystack, cloud infrastructure). We do not offer a contractual SLA or uptime credits at this time.

9. Termination

You may cancel your subscription at any time. We reserve the right to suspend or terminate accounts that violate these Terms, with notice where reasonably practicable. On termination, your data is retained for five years in accordance with our Privacy Policy, after which it is deleted.

10. Governing Law

These Terms are governed by the laws of South Africa. Disputes shall be resolved in the courts of the Western Cape, South Africa, unless required otherwise by applicable law.
